This Refund Policy applies to all purchases of MaConSim Software subscriptions and licenses made through our authorized reseller, Paddle.com Market Ltd. ("Paddle").
1. General Refund Terms
1.1 All purchases, payments, and refunds for MaConSim Software are processed exclusively by Paddle, acting as the Merchant of Record. MaConSim GmbH does not handle payments or issue refunds directly.
1.2 Unless required by applicable law, transactions are generally non-refundable and non-exchangeable.
1.3 Paddle may issue refunds on a discretionary basis and/or where statutory withdrawal or refund rights apply, in each case subject to Paddle's Refund Policy.
1.4 By purchasing through Paddle, you agree to be bound by both this Refund Policy and Paddle's Refund Policy.
2. How to Request a Refund
To request a refund, visit Paddle Support and follow Paddle's refund request process.
3. Refund Eligibility
Refund eligibility is determined by Paddle in accordance with the current Paddle Refund Policy.
MaConSim Software is offered exclusively to businesses and institutions under the EULA. Any mandatory consumer withdrawal or refund rights apply only where a transaction is legally classified as a consumer transaction and such rights are required under applicable law.
4. Subscription Cancellations
4.1 You may cancel your subscription at any time via the Paddle Customer Portal.
4.2 Cancellation takes effect at the end of the current billing period. No refunds are issued for prepaid periods unless required by applicable law or approved under Paddle's discretionary policy.
4.3 To avoid being charged for the next billing cycle, cancel before the renewal date.
5. MaConSim's Role
5.1 MaConSim GmbH cannot influence Paddle's refund decisions but may provide product-specific information to support the refund process (e.g., confirming technical issues or usage details).
5.2 Termination of your license due to violations of the EULA (e.g., unauthorized use, reverse engineering, or use in sanctioned countries) does not entitle you to a refund. See Section 12.2 of the EULA for details.
6. Governing Law
This Refund Policy is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent it governs the relationship between you and MaConSim GmbH. Refund processing, eligibility decisions, and refund-related disputes handled by Paddle are governed by Paddle's applicable terms and policies, including the Paddle Refund Policy and Paddle Buyer Terms.
7. Changes to This Policy
MaConSim GmbH reserves the right to update this Refund Policy at any time. Continued use of the Software after changes constitutes acceptance of the updated policy. The version effective at the time of purchase governs your transaction.
